SAMPLE MEDIATION TERMS
In order to ensure that the mediation agreement clearly expresses the will of the parties to choose to settle disputes arising out of or related to the contract by conciliation at the Real Estate Enterprise Commercial Mediation Center (“REECMC”). REECMC as well as in terms of pre-defining some of the basic elements of the mediation procedure, the REECMC recommends that contracting parties use one of the following Model Mediation Agreements:
Form 1:
“Article…: Settlement of Disputes by REECMC
Any dispute arising out of or in connection with this Agreement shall be resolved by conciliation at REECMC in accordance with this Mediation Center Rules.”
Form 2:
“Article…: Settlement of Disputes by REECMC
- Any dispute arising out of or in connection with this Agreement shall be resolved by conciliation at the REECMC in accordance with this REECMC’s Rules.
- The two parties will agree to select a Mediator from the List of Mediators of REECMC.”
Form 3:
“Article…: Settlement of Disputes by REECMC
Any dispute arising out of or in connection with this Agreement shall be resolved by conciliation at the REECMC in accordance with REECMC’s Rules.
The two parties will agree to select a Mediator from the List of Mediators of REECMC.
This mediation agreement does not exclude the right of each party to bring the case to Court.”
